American Music superstar, Ed Sheeran may be going to trial over alleged ‘Thinking Out Loud’ copyright infringement.

The four-time Grammy award-winning artist will face trial to determine whether his 2014 hit, “Thinking Out Loud,” ripped off elements from Marvin Gaye’s “Lets Get It On.”

The lawsuit was reportedly filed for the first time in 2018, and Sheeran has been avoiding the court, as his lawyers said the accusations were baseless.

Structured Asset Sales, an entity that owns a third of the stake in the estate of Ed Townsend, Gaye’s co-writer, filed the lawsuit.

Structured Asset Sales is reportedly seeking $100 million in damages, and Judge Louis Stanton affirmed that the case can only be settled in court.

He said:

“There is no bright-line rule. A work may be copyrightable even though it is entirely a compilation of unprotectable elements.”

This is not the first hit song that has faced copyright infringement lawsuits.

ed Sheeran won the copyright lawsuit against his ‘Shape of you’ hit song and he was awarded $1.1 million for damages.
