Jamie Foxx Sued By Woman For Alleged Sexual Assault In 2015


A woman is suing Academy Award-winning actor and musician Jamie Foxx, alleging he sexually assaulted her in August 2015 at a rooftop bar.

The lawsuit, which was submitted to the New York Supreme Court on Wednesday, claims that Foxx violated the nameless woman further after penetrating her trousers and fondling her. The New York Survivors Act allows adult survivors of sexual assault one year to file a lawsuit, regardless of when the statute of limitations expires, and it was filed just two days before that date.

On Thursday, a Foxx representative informed NBC News that “the alleged incident never happened.”

As per the spokesperson, Foxx plans to file a claim for malicious prosecution.

The woman claims that after seeing Foxx, who was having drinks with the owner of Catch NYC & Roof and a co-founder, they went over to ask for a photo. She and her friend had been seated across from him at the table. According to the lawsuit, while they were shooting, a “intoxicated” Foxx “roughly” grabbed the woman’s phone and proceeded to take more photos, making suggestive remarks like “Wow, you have that super model body.”

The suit claims that after grabbing her arm and dragging her to the back of the rooftop, he slipped his hand under her shirt and started massaging her breasts.

According to the court document, the woman attempted to back away, but Foxx slid his hands into her pants and put his fingers on and in her anus and vagina.

The lawsuit claims that a security guard saw what was happening but chose to leave. It also says that Foxx stopped touching the woman and moved to talk to the security guard when the woman’s friend approached.

The lawsuit also names Catch NYC & Roof, a rooftop bar located in New York at 21 Ninth Ave., as well as Catch NYC Inc., Catch Hospitality Group, and Catch’s owner, Mark Birnbaum. Requests for comment from Catch NYC and Birnbaum were not immediately answered on Wednesday night.
